Site Goals and Sources Of Content

The goal of this web site is to provide access to Health and Environmental information to members of the general public who have an interest in Cruise Ship Illness Rates. Information provided on this site comes from four distinct sources: government agencies, books and research papers, editorial comment, and personal comments from users ("Users") of the Site. ("Site"). Disease Strategies is a firm supporter of free speech for all of users, however, we also have a commitment to create an environment that meets all legal, social and ethical standards.

The following User Agreement ("Agreement") governs the use of the “Site” and its related services, including “User” participation on Site. Please read the rules contained in this Agreement carefully. By accessing any areas of “Site”, users agree to abide by and be legally bound by all the terms in this agreement. Continued use of this service by you will also constitute your acceptance to any subsequent changes and revisions to this Agreement.

 

User Content: Responsibility, Privacy and Ownership

The User is solely responsible for the contents of his or her Email Messages and Site postings, whether be original material created by the User, or other materials created by a third party and posted or transmitted by the User to “Site”. This Site makes use of the Internet to send and receive messages so User's conduct is subject to all Internet regulations, policies and procedures. User agrees not to transmit, or make available to other users, any unlawful, harassing, abusive, threatening, harmful, vulgar, libelous, obscene or otherwise objectionable material of any kind or nature.

User further agrees not to transmit any Content that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law or regulation at the local, state, national or international levels. Further, Users shall not interfere with any other User's use, rights and enjoyment of the Site.

Disease Strategies will not monitor, edit, or disclose the contents of a User's private communications unless required to do so by law or in the good faith belief that such action is necessary to: (1) conform to the law or comply with legal process served on Disease Strategies; (2) protect and defend the rights or property of Disease Strategies; or (3) act under essential circumstances to protect the personal safety of its Users or the general public.

All public communications, including Content posted to the Site's Chronicles and Forums area, User automatically warrants that the owner of such Content has expressly granted Disease Strategies the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, modify, publish, sublicense, copy and distribute the Content in whole or in part worldwide. Disease Strategies or its designated agent, may incorporate it in other works in any form, media, or technology for the term of any copyright that exists for the Content. The owner of the content also grants other Users of the Site the right to access, store and reproduce the Content for their personal use. Subject to these grants, the owner of Content placed on Disease Strategies retains any and all rights which may exist in such Content.

User may submit only Content on Site that is not subject to any copyright or other proprietary rights protection, or Content in which the author has given express authorization for distribution on the World Wide Web. Any copyrighted or other proprietary Content distributed with the consent of a copyright owner should contain a phrase such as "Copyright [year], owned by [name]; used by permission." Unauthorized submission of copyrighted material could subject the User to criminal prosecution as well as personal liability damages in a civil suit.

 

Third Party Content

Content supplied by Health Care Providers, Merchants, Sponsors, Licensers or any other User of Site is considered collectively as ("Third Party Content"). Disease Strategies has no more control over Third Party Content than a public library. Any information provided by these Third Parties, such as opinions, advice, statements, services or offers are those of the respective authors and legal entities. Further, neither Disease Strategies nor its affiliates, nor any of its officers, directors, employees, or agents, nor any third party, including any Provider, Merchant, Sponsor, Licenser, or any other User of Site, guarantees the accuracy, completeness, or usefulness of any Content, nor its merchantability or fitness for any particular purpose.

 

Disclaimers And Limitation Of Liability

User expressly agrees that use of Site is at User's sole risk. Neither Disease Strategies nor its affiliates, nor any of its officers, directors, or employees, agents, third-party content providers ("Providers"), merchants ("Merchants"), sponsors ("Sponsors"), licensers ("Licensers"), or the like, warrant that this web site to be error-free; nor do they make any warranty as to the results that may be obtained from the use of these ‘Sites’, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through this Site.\

Disease Strategies is provided on an "as is" basis without warranties of any kind, either expressed or implied, including but not limited to warranties of content or implied warranties of merchantability or fitness for a particular purpose. No oral advice or written information given by Disease Strategies nor its affiliates, nor any of its officers, directors, employees, agents, Providers, Merchants, Sponsors, Licensers, or the like, shall create a warranty; nor shall User rely on any such information or advice. Personal health is the sole responsibility of the individual, not the information provider.

Under no circumstances shall Disease Strategies or any other party involved in creating, producing, or distributing JerseyHealth.org be liable for any direct, indirect, incidental, special, or consequential damages that result from the use of Site, including but not limited to reliance by a User on any information obtained from Site is not liable for any and all mistakes, omissions, interruptions of service, errors, defects, viruses, operational or communication delays, or any other failure. User hereby acknowledges that this paragraph shall apply to all content and services available through these ‘Sites’.

Some states do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above exclusions may not apply to you. The User may also have other rights which vary from state to state.

 

Proprietary Rights

User acknowledges that Site contains information, data, software, photographs, graphs, videos, typefaces, graphics, music, sounds, and other material (collectively "Content") that are protected by copyrights, trademarks, trade secrets, or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies. All Site Content is copyrighted as a collective work under the U.S. copyright laws, and Site owns a copyright in the selection, coordination and presentation of such Content. User may not modify, remove, delete, augment, add to, publish, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part without express written permission of the copyright owner.

If no specific restrictions are displayed, Users may make copies of select portions of the Content, provided that the copies are made only for User's personal use and that User maintains any notices contained in the Content, such as all copyright notices, trademark legends, or other proprietary rights notices. Except as provided in the preceding sentence or as permitted by the fair use privilege under the U.S. copyright laws (see e.g. 17 U.S.C. Section 107), User may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other propriety right.

 

Distribution Of Third Party Content

The unauthorized submission or distribution of copyrighted or other proprietary Content is illegal and could subject the User to criminal prosecution as well as personal liability for damages in a civil suit. User, not Disease Strategies, nor its affiliates, nor any of its officers, directors, employees, agents, Merchants, Providers, Sponsors, Licensers, or the like, will be liable for any damage resulting from any infringement of copyrights or proprietary rights, or from any other harm arising from such submission.

 

Content Editing and Deletions

The Service Provider reserves the right, but undertakes no duty, to review, edit, move, or delete any material provided for display or placed on the Service or its bulletin boards, in its sole discretion, without notice.

 

Termination

Either User or Site may terminate the Service with or without cause at any time. Termination does not require a written or advance notice to the other party. Disease Strategies shall not be liable to User or any third party for termination of Site or Site Services. Your failure to follow any of the rules stated in this Agreement may result in immediate termination of your access to Site. If, at any time, any information provided by the User is inaccurate or violates the "User Content" clause contained herein, Disease Strategies retains the right to terminate User.

Should User object to any terms and conditions of this Agreement or subsequent modifications to this Agreement or become dissatisfied with the Service in any way, User's only regroup is to immediately (1) discontinue use of the Service, (2) terminate the Site Service. Optionally, email notice may be given to vesselhealth@earthlink.net. Upon termination of the Service, User's right to use the Site, Service and any Site related materials and / or information immediately ceases. User shall have no right and Disease Strategies will have no obligation thereafter to forward any unread or unsent messages or continue posting of previous messages on the Site from that user.

 

Trademarks

"Med-Poll" is a service and product mark from Site. All Rights Reserved. All other trademarks, product names and company names and logos appearing on Site are the property of the respective owners.

 

Advertiser / User Correspondence

Disease Strategies assumes no liability, obligation or responsibility for any advertiser showing their products on the Site. Any correspondence of any form between Site Users and Site Advertisers, including the delivery of and payment for goods and services as well as all other terms, conditions, representations are solely between the User and the Advertiser.
